Court Delays Key Ruling Amid Legal Dispute Over Chief Justice's Removal

Story Highlights
  • The case concerning the Chief Justice's removal is postponed to May 6 due to the absence of a Justice
  • Dr. Dominic Ayine rejects calls to halt the President's constitutional duty in the proceedings
  • Dispute centers on whether the President can be prevented from deciding on the prima facie case in the CJ removal petition

The Supreme Court has once again delayed the hearing of an application seeking to prevent the President and Council of State from determining if there is a prima facie case in the petitions for the Chief Justice’s removal.

The delay occurred due to the absence of one of the five Justices, His Lordship Samuel Asiedu, when the case was called. Presiding Judge, Her Ladyship Henrietta Mensah Bonsu, explained that “unavoidable reasons” led to the adjournment, setting the new hearing date for May 6.

In the meantime, Attorney General Dr. Dominic Ayine has firmly rejected calls for President John Dramani Mahama to pause the proceedings on determining the prima facie case in the Chief Justice’s removal petitions.

His comments came in response to a statement by the plaintiff’s lawyer, Godfred Yeboah Dame, who had requested an injunction to stop the President from moving forward with the proceedings.

Dr. Ayine, speaking to the press on April 16, stressed that the President cannot be blocked from performing his constitutional duty.
