Supreme Court Overrules Objection in NDC’s Bid to Halt Re-collation

Court Accepts Supplemental Filing, Clears Path for NDC to Challenge Re-collation of Election Results

Story Highlights
  • The Supreme Court rejected the NPP lawyer’s procedural challenge against the NDC
  • The court allowed the NDC to rectify its initial oversight by submitting the High Court ruling later
  • The decision enables the NDC to continue its bid to overturn the High Court’s re-collation order

The Supreme Court has dismissed a preliminary objection against the National Democratic Congress (NDC) in its effort to nullify a High Court ruling that mandated a re-collation of parliamentary election results in six constituencies.

The objection, filed by Gary Nimako Marfo, lawyer for the New Patriotic Party (NPP) parliamentary candidates, argued that the NDC’s application was procedurally flawed due to an initial failure to include the High Court’s decision in its filing.

On Friday, December 27, the five-member Supreme Court panel, led by Justice Gabriel Pwamang, ruled in favor of the NDC.

The court accepted the party’s subsequent submission of the High Court ruling as a supplemental affidavit, deciding to proceed with the case.

This decision paves the way for further legal arguments as the NDC seeks to overturn the High Court’s directive for a re-collation of the results. The next phase of the legal battle promises to draw significant attention.
