The Ghana Bar Association (GBA) has called for the immediate reversal of Chief Justice Gertrude Torkornoo’s suspension, condemning the move as unconstitutional and without legal foundation according to Ghana’s 1992 Constitution.

In a statement issued on April 26, the GBA argued that the President’s decision to suspend the Chief Justice under Article 146(10) of the Constitution was flawed, as no constitutional instrument, statutory regulation, or clear framework was provided to govern the exercise of this presidential power. This, the Association stated, is in direct violation of Article 296 of the Constitution.

“The suspension of the Chief Justice is unconstitutional,” the statement read, urging for its immediate revocation.

The GBA also demanded that the government swiftly enact clear regulations to guide the impeachment or removal process for Superior Court justices under Article 146. The absence of such guidelines, the GBA argued, risks compromising transparency and fairness in judicial proceedings.

Additionally, the Association called on the President to disclose the full reasoning behind the decision to suspend Chief Justice Torkornoo, which would align with legal precedent and ensure procedural transparency.

The GBA also criticized what it called politically motivated and prejudicial comments surrounding the case, warning that such statements could damage public confidence in the judiciary.

“The GBA stands firm in its commitment to protect the independence and integrity of the judiciary and will take all necessary legal steps to prevent undue interference and unjust attacks,” the statement concluded.

The suspension has sparked intense debate in Ghana’s legal and political spheres, with the nation closely monitoring the situation as it develops.
