Accra, Ghana – Former Managing Director of SIC Insurance Company Limited, Hollistar Duah-Yentumi, has initiated legal action against the company and its newly appointed Acting MD, Mr. James Agyenim-Boateng.
This legal action follows her refusal to step down from her position after President John Dramani Mahama appointed Mr. Agyenim-Boateng as her replacement on January 27th.
In a lawsuit filed on February 4th, Madam Duah-Yentumi contends that her appointment was secured by a four-year contract, with an expiration date of January 1st, 2028.
She argues that any changes to her tenure must be approved by the company’s Board of Directors or through a resolution by all shareholders at an Annual General Meeting.
Madam Duah-Yentumi asserts that the termination of her employment is unlawful, as it violates the terms of her contract.
She maintains that only the Board of Directors or the collective shareholders have the authority to terminate her employment.
Consequently, she argues that the appointment of Mr. Agyenim-Boateng is both procedurally flawed and illegal.
As part of her legal reliefs, Madam Duah-Yentumi is seeking a court declaration that the termination of her employment is null and void.
She is also requesting the court to overturn the appointment of Mr. Agyenim-Boateng and reinstate her as the legitimate MD of SIC Insurance Company Limited.
Furthermore, Madam Duah-Yentumi’s legal team is demanding that the defendants compensate her for the entire salary and benefits due for the remaining period of her contract.
