The National Democratic Congress (NDC) Legal Team has criticized the Electoral Commission (EC), led by Jean Mensa, for nullifying parliamentary results in nine constituencies from the December 7, 2024, general elections.
The team has vowed to resist any attempts by the EC to re-collate or alter the results, calling such actions unlawful.
On Thursday, December 19, 2024, the EC announced its decision not to uphold the results from the affected constituencies, citing disruptions during the collation process. The constituencies involved are Nsawam-Adoagyiri, Ahafo Ano South West, Ahafo Ano North, Obuasi East, Dome-Kwabenya, Okaikwei Central, Ablekuma North, Tema Central, and Techiman South.
Speaking at a press conference, Jean Mensa explained that the disruptions, allegedly caused by supporters of political parties, rendered the collation process incomplete. “Upholding such unlawful collations and declarations will set a bad precedent for our country and take us back to the dark days,” she stated.
However, during an interview on the Ghana Se Sen Morning Show on Lawson TV/Radio, Twum Barimah, a member of the NDC Legal Team, dismissed the EC’s authority to withhold parliamentary results.
“Jean Mensa has no role in parliamentary elections; that is the responsibility of returning officers. Her decision to nullify these results is outside the law, and we will not allow her to act illegally,” Twum Barimah said.
He condemned any acts of vandalism or disruptions, whether by NDC or NPP supporters, but questioned the EC’s legal basis for its actions.
Twum Barimah urged Jean Mensa to revisit the electoral laws, referencing her rejection of the NDC’s 2020 petition to re-collate results in Techiman South, where eight people reportedly lost their lives.
The NDC Legal Team insists that parliamentary elections fall strictly under the jurisdiction of returning officers, not the EC chairperson, and is determined to challenge any unlawful interventions.
