Court Orders EC to Finalize Polling Results in Four Key Constituencies by January 6
Mandamus ruling compels the Electoral Commission to complete collation in Tema Central, Ablekuma North, Okaikwei Central, and Techiman South, with armed security support
- The EC must finalize collation by January 6, 2025, under court orders
- Armed police security mandated for the collation process
- Incomplete results from multiple polling stations prompted the court’s intervention
The High Court in Accra has directed the Electoral Commission (EC) to complete the collation of election results in Tema Central, Ablekuma North, Okaikwei Central, and Techiman South constituencies by January 6, 2025.
The court further instructed the Inspector General of Police to deploy adequate armed security to ensure a smooth collation process in the affected areas.
This ruling follows mandamus applications filed by New Patriotic Party (NPP) candidates in these constituencies.
Justice Forson Agyapong, who presided over the cases, emphasized that the EC failed to fulfill its statutory duty by declaring incomplete results in these areas.
Key Findings:
- Tema Central: The EC failed to include results from two polling stations.
- Ablekuma North: Results were declared from only 219 out of 281 polling stations, leaving 62 uncollated.
- Okaikwei Central: Results were based on 110 out of 141 polling stations, omitting 31.
- Techiman South: The EC declared results from only 135 out of 282 polling stations.
Justice Agyapong ruled that any declaration made without the inclusion of these outstanding polling stations is invalid. The court ordered the EC to finalize collation and announce accurate results.
This decision underscores the legal principle that public institutions must fulfill their obligations in accordance with law, particularly in matters affecting public trust and governance.
