Court Orders Immediate Release of Results, Slams WAEC with Fine

- An Accra High Court has dismissed the West African Examinations Council (WAEC)’s request for a stay of execution
- WAEC had previously withheld the results of about 10,000 WASSCE candidates across various subjects
- The judge ruled that WAEC had failed to provide adequate grounds for their actions
An Accra High Court has dismissed the West African Examinations Council (WAEC)’s request for a stay of execution concerning an earlier ruling that directed the release of withheld West African Senior School Certificate Examination (WASSCE) results.
WAEC had previously withheld the results of about 10,000 WASSCE candidates across various subjects, citing suspected examination malpractices and irregularities in an announcement made on December 30, 2024.
However, on January 30, 2025, the High Court ruled in favor of four students who had filed a petition on behalf of all affected candidates.
The court ordered WAEC to release the results without any disclaimers, stating that the council’s reasoning for withholding the results was unclear and inconsistent.
The court emphasized that continuing to withhold the results could significantly impact the academic and professional advancement of the students.
Despite the court’s decision, WAEC applied for a stay of execution while appealing the ruling. On February 20, 2025, during a hearing, Justice Ali Baba Abature, who presided over the case, rejected WAEC’s application.
The judge ruled that WAEC had failed to provide adequate grounds for their actions. Additionally, the court imposed a GHS 5,000 fine on WAEC.
